DISCOVER ARTISTS PRIVACY POLICY

This policy is separate from our Talent Representation Agreement and is applicable regardless of the stage of your relationship with our agency. We are committed to safeguarding your privacy and ensuring the security of your personal information. By using our website and engaging with our services, you consent to the practices described in this Privacy Policy.
 

We are Discover Artists, LTD and are responsible for deciding how we use and hold personal data about you. We are required under the General Data Protection Regulation 2018 (the “GDPR”) to notify you of the information contained in this Privacy Policy.

1.1 We may collect, store and use personal information about you, including but not limited to:

  • Personal contact details such as name, title, addresses, telephone numbers, and personal email addresses
  • Gender, age, nationality, citizenship status
  • Photographic Identification (Passport/ driving license etc)
  • Photographs, videos, and other media used as documentation for your acting profile or in the process of submissions
  • Casting information, such as body measurements, and descriptions of your skin, hair, and eye colour.
  • Your CV, including education, training, work history and professional memberships
  • Health-related data, including both physical and mental well-being.
  • Payment and financial information necessary for billing and accounting purposes (National Insurance number, Bank account details and Tax status information)
  • Agency client engagement information including copies of right to work documentation
  • Details regarding payments, fees, and any interest or connections with intermediaries involved in the provision of your services, as well as royalty payments.
  • Information concerning merchandising, commercial tie-up rights, advertising, intellectual property rights, and other aspects related to the utilisation of your rights.
  • Specifics about contractual negotiations carried out on your behalf with third parties.
  • Information about the projects or engagements in which you are currently or have previously been involved.
  • Records of disputes, disciplinary actions, and grievances related to projects, employment, or work with third parties.
  • Details about your marital status, family, lifestyle, social circumstances, and any other relevant information concerning the agency-client relationship, particularly when liaising with third parties regarding your reputation or reliability.
  • Information pertaining to your assets and beneficiaries, such as details found in your will or instances where you have transferred your beneficial interest in your work or other rights to individuals and/or companies.Information regarding criminal convictions or offences.
  • Certain personal information may also belong to "special categories" of highly sensitive personal data, including details regarding to your race or ethnicity, religious beliefs, sexual orientation, and political opinions. This also includes information about your trade union memberships, health-related data encompassing medical conditions, health records, genetic information, and biometric data. Additionally, personal data concerning criminal convictions and offences is part of this category.

1.2 Automatically Collected Information:

  • Throughout the agency onboarding process before you appoint us as your agent (including representation requests, meetings, correspondences and submissions)
  • As part of our responsibility as your Agent to fulfil our obligations in our Talent Representation Agreement. 

2.2 Additionally, we may employ and retain personal data about you obtained from:

  • Public sources such as Spotlight, social media, IMDB
  • Information generated about you in fulfilling our contractual obligations under the Talent Representation Agreement; and

3.1 Talent Representation

We collect and process your personal information for the purpose of representing you as an acting client. This includes activities such as submitting your profile to potential employers, arranging auditions, negotiating contracts, and providing ongoing career support.

The following situations outline the use of your personal data along with the legal grounds for processing. There may be overlapping legal grounds, and multiple justifications may support our use of your personal data. The processing of your personal data is necessary for:

  • Assessing whether to take you on as a client for Discover Artists
  • Determining the terms of our professional agreement with you.
  • Keeping you updated and providing reports
  • Representing you as a client of our agency
  • Finding and recommending you for new projects and engagements
  • Creating an artist/performer profile on our casting database to evaluate your suitability for roles and projects and facilitate profile sharing with casting directors, producers, and third-party casting databases.
  • Negotiating the terms of your engagement on new projects, including services, fees, payments, work benefits, working hours, and contractual matters.
  • Managing your affairs, servicing contracts, and handling intellectual property rights, licenses, and royalties.
  • Processing payments, invoices, VAT, and commissions
  • Arranging the termination of the Talent Representation Agreement 

3.2 Promotion and Marketing

We may use Actors' personal information to promote and market their talents and services to industry professionals, including casting directors, producers, and directors. This may involve sharing Actors' headshots, CVs, and portfolio materials in various formats, such as printed materials, online profiles, and casting platforms.

3.3 Communication:

We use out Talents' personal information to communicate with them regarding casting opportunities, auditions, career updates, industry news, and promotional activities. This may involve email, phone calls, text messages, or other communication channels.

3.4 Legal Compliance:

We may process Talents' personal information to comply with applicable laws, regulations, or legal obligations, including responding to lawful requests and protecting our rights, property, or safety.

3.5 Website and Communication:

We may use your personal information to personalise your website experience, respond to inquiries, communicate important updates, and provide you with marketing materials, newsletters, or promotional offers. You have the right to opt-out of receiving such communications at any time.


4. Information Sharing and Disclosure

4.1 Industry Professionals:

We may share Actors' personal information, including headshots, resumes, and portfolio materials, with casting directors, producers, and other industry professionals involved in the casting process, for the purpose of talent representation and securing employment opportunities. However, we will only share information with your explicit consent or when necessary to further your professional interests.

4.2 Service Providers:

We may engage trusted third-party service providers to assist us in delivering our talent representation services. These providers may have access to Actors' personal information but are obligated to maintain its confidentiality and security.

4.3 Legal Requirements:

We may disclose Actors' personal information if required to do so by law or in response to valid legal requests, such as subpoenas, court orders, or government regulations.

4.4 Consent

We will seek your consent before sharing any personal information that is not covered by the aforementioned scenarios.


5. Data Security

We have implemented reasonable security measures to protect Actors' personal information from unauthorised access, disclosure, alteration, or destruction. However, no data transmission or storage system can be guaranteed to be 100% secure. Therefore, while we strive to protect your information, we cannot guarantee its absolute security.

We will retain Actors' personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.
